I, the undersigned participant, hereby acknowledge and agree that by attending, participating in, spectating, or otherwise engaging in any activities, gatherings, or events hosted, organized, managed, or affiliated with SouthBay AutoClub LLC, a California Limited Liability Company, including but not limited to car meets, rallies, exhibitions, track days, cruises, shows, networking events, vendor markets, or any other event, whether on public or private property, I fully understand and expressly assume all risks associated with my participation, including but not limited to the inherent dangers of automobile-related activities, high-speed driving, vehicle malfunctions, accidents, collisions, personal injury, death, property damage, theft, fire, explosions, adverse weather conditions, roadway hazards, actions of other participants or spectators, negligence, gross negligence, willful misconduct, criminal activities, and unforeseen circumstances beyond the control of SouthBay AutoClub LLC. I acknowledge that participation in or attendance at these events is voluntary and may involve dangerous activities that could result in severe bodily injury, permanent disability, paralysis, or death, and I accept full and complete responsibility for my actions and any consequences arising therefrom. I further acknowledge that SouthBay AutoClub LLC, its owners, officers, directors, members, managers, employees, contractors, volunteers, sponsors, partners, affiliates, agents, landlords, venue owners, vendors, and any other associated parties (collectively, the “Released Parties”) are in no way responsible for ensuring my safety, nor are they responsible for any injury, death, damage, or loss I may sustain, whether caused by the actions, negligence, or omissions of any party, including other participants, spectators, vendors, or third parties. I hereby expressly waive, release, discharge, and hold harmless the Released Parties from any and all liability, claims, demands, causes of action, lawsuits, damages, losses, legal fees, medical costs, and expenses of any kind or nature, including those based on negligence, gross negligence, strict liability, breach of warranty, premises liability, or any other legal theory, arising out of or relating to my participation in or presence at any event hosted by SouthBay AutoClub LLC. I further agree to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, or lawsuits brought against them by third parties due to my actions, conduct, or participation, including but not limited to injuries, accidents, property damage, or legal violations. I understand and agree that this waiver extends to any and all claims I may have now or in the future, known or unknown, arising under California Civil Code Section 1542, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” I knowingly and voluntarily waive all rights under Section 1542 and understand that by signing this waiver, I may be giving up rights I do not yet know exist. I agree that SouthBay AutoClub LLC does not provide insurance coverage for participants or spectators and that I am solely responsible for obtaining any insurance I deem necessary, including but not limited to medical, health, liability, and vehicle insurance. I also acknowledge that SouthBay AutoClub LLC reserves the right to refuse entry, participation, or continued attendance at any event for any reason, including but not limited to violation of event rules, reckless behavior, intoxication, disruptive conduct, or failure to comply with instructions from event staff, security, or law enforcement. I further acknowledge that I am solely responsible for the security of my own vehicle, property, and belongings at any event, and the Released Parties shall not be liable for any theft, loss, or damage to personal property. I understand that SouthBay AutoClub LLC may capture photos, videos, and other media content during events for promotional, marketing, and business purposes, and by signing this waiver, I grant SouthBay AutoClub LLC and its affiliates the unrestricted right to use, reproduce, distribute, and display my likeness, image, and voice in any media without compensation or approval. I further acknowledge that this waiver and release is binding upon my heirs, executors, administrators, assigns, and personal representatives and is intended to be as broad and inclusive as permitted by the laws of the State of California. If any provision of this waiver is found to be unenforceable, such provision shall be severed, and the remaining terms shall remain in full force and effect. I acknowledge that I have read and understood this waiver in its entirety, that I have had the opportunity to seek legal counsel before signing, and that I voluntarily agree to all its terms without any duress, coercion, or reliance on representations made by SouthBay AutoClub LLC or any of its affiliates. By signing below, I affirm that I am at least 18 years old or that I have obtained parental or legal guardian consent if I am a minor, and that I fully and voluntarily assume all risks associated with participation in SouthBay AutoClub LLC events. I, the undersigned participant, hereby grant SouthBay AutoClub LLC, its affiliates, sponsors, vendors, media partners, photographers, videographers, employees, contractors, agents, assigns, and licensees (collectively, the "Released Parties") the unrestricted, worldwide, irrevocable, royalty-free, perpetual right and permission to record, capture, photograph, film, videotape, livestream, or otherwise document my image, likeness, voice, appearance, statements, and performance (collectively, the "Media") in connection with any event, activity, or gathering hosted, organized, or affiliated with SouthBay AutoClub LLC. I understand and agree that the Released Parties may use, reproduce, distribute, publish, edit, modify, adapt, create derivative works from, display, or otherwise exploit the Media in any manner and for any purpose, including but not limited to advertising, marketing, promotions, social media, websites, print materials, documentaries, commercial distribution, sponsorships, and any other business-related purposes, without further approval or compensation to me. I further acknowledge that I have no ownership, copyright, or claim to the Media, and I waive any rights of publicity, privacy, or any claims against SouthBay AutoClub LLC or any Released Parties relating to the use of my likeness or image. I understand that SouthBay AutoClub LLC is not obligated to use any Media containing my likeness and that all Media will remain the exclusive property of SouthBay AutoClub LLC and its assigns. I expressly waive any right to inspect or approve the final product in which my likeness or voice may appear, including any written copy, digital use, or printed material accompanying such Media. Additionally, I release, waive, and hold harmless the Released Parties from any claims, demands, or causes of action arising out of or relating to the use of my likeness, including but not limited to defamation, misrepresentation, invasion of privacy, commercial misappropriation, or infringement of rights under California law or any other jurisdiction.If I am signing this release on behalf of a minor child (under 18 years old), I affirm that I am the parent or legal guardian of the minor and that I grant full consent for the minor’s likeness, voice, and image to be used as described in this agreement. This Media Release is binding upon my heirs, executors, administrators, assigns, and personal representatives and shall remain in effect permanently unless revoked in writing, with such revocation not applying to any previously captured Media.I acknowledge that I have read and understood this Media Release in its entirety, that I have had the opportunity to seek legal counsel before signing, and that I am signing this voluntarily without duress or expectation of compensation.
