I understand that participation is completely my choice, and I choose to participate for my own personal benefit. I am fully aware of the risks involved with participation, and I expressly, voluntarily, and willingly assume full responsibility for all risks and dangers associated with such participation, including, but not limited to, risk of bodily injury (including permanent disability or death) or property damage arising out of my participation, howsoever caused, and I accept personal responsibility for the damages arising from any such injury or property damage and hold the Released Parties harmless therefrom. I expressly waive any defense to enforcement of this Agreement arising from any claim of lack of consideration and understand that this Agreement constitutes a legal, valid, and binding waiver of my rights and shall be enforceable against me, my spouse, family, heirs, assigns, personal representatives and estate for all purposes. I understand that my automobile(s) and I may be photographed or filmed during the event and agree to allow SouthBay AutoClub to use any photographs, video image, or film likeness of me or my automobile(s)/motorcycle(s) for any legitimate purpose, including without limitation publication and program inclusion now and in the future, without financial compensation to me. There is to be no racing or betting during this “Event”. All participants must abide by all laws, and not drive recklessly. All participants must drive safely and respect all other participants. If you are seen violating any laws, rules, or posing as a threat to other’s safety, you will not be allowed to participate. No bets are to be placed of any kind, whatsoever. You must NOT drive if you are under the influence of any drugs, alcohol, or any other substance which may impair your ability to drive. You must comply with all applicable laws and regulations of the city, county, state, and country of the “Event”. All speed regulations, laws of the road, laws relating to your safety, and the safety of your passenger and vehicle must be followed. Failure to do so may result in a ban from all future events. SouthBay AutoClub accepts no responsibility for the consequences of you being cited, charged, damage to your vehicle or third party vehicle, prosecuted, or anything else which may happen to you or your vehicle. You accept full responsibility for your actions during this “Event”. You MUST obtain the appropriate and proper insurance coverage for your participation in the “Event”. This includes, but is not limited to, auto insurance, life insurance, health insurance, or anything else that may apply. You will indemnify the SouthBay AutoClub, its directors, officers, and volunteers against any and all claims, lawsuits, and causes of action whatsoever or howsoever arising and brought against them by any third party as a result of your action and participation in the Event, including but not limited to, your violation of any laws or regulations or your breach of these Terms and Conditions. The registration fee excludes the cost of personal expenses such as gas, independent stops, any fines, or damages from the consequences you may cause. No refunds of the registration fee will be made under any circumstances unless otherwise stated. I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. I further acknowledge that SouthBay AutoClub has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. I further acknowledge that SouthBay AutoClub can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others. I am voluntarily attending events provided by SouthBay AutoClub and acknowledge that I am increasing my risk of exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending the event. I attest that: * I am not experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell. * I have not traveled internationally within the last 14 days. * I have not traveled to a highly impacted area within the United States of America in the last 14 days. * I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19. * I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities. * I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19. I hereby release and agree to hold SouthBay AutoClub harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the event, or that may otherwise arise in any way in connection with any services/products received from SouthBay AutoClub. I understand that this release discharges SouthBay AutoClub from any liability or claim that I, my heirs, or any personal representatives may have against the event with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services/products received from SouthBay AutoClub. This liability waiver and release extends to the event hosts together with all owners, partners, and employees. I have carefully read this Agreement, and my completion of payment acknowledges that I fully understand its content and meaning. I understand that I have given up substantial rights by signing this Agreement, and I sign it freely and voluntarily without any inducement. If I am signing this Agreement on behalf of a minor, I certify that all representations are true and that I have full authority to bind the minor and myself to the terms and conditions of this Agreement.
